The Momentum app ("Service") is provided by Tek ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
You must be of legal age in your jurisdiction, or represent an organisation with authority to bind it. You are responsible for the accuracy of your account information and for maintaining the confidentiality of your credentials and any activity under your account.
Momentum is a habit-tracking application. We may improve, change, or discontinue features from time to time. We do not guarantee that the Service will be uninterrupted or error-free.
You will not:
We retain all rights, title, and interest in the Service, including software, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
You retain ownership of the content you enter. You grant us a limited, worldwide licence to host and process it solely to provide the Service.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms. Subscriptions renew automatically for the interval selected at checkout until cancelled through the billing portal.
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination your right to use the Service ends immediately.
To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid in the twelve months preceding the claim, and we exclude indirect, consequential, special, or incidental damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.
You will indemnify us against third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
These Terms are governed by the laws of the jurisdiction in which Tek is established, without regard to its conflict of laws rules. Disputes are subject to the exclusive jurisdiction of the competent courts of that jurisdiction.
We may update these Terms from time to time; the "Last updated" date reflects the latest revision.
